Welcome to MMD Fitness (“we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your access to and use of our coaching services, digital programs, websites, and other related products or services (collectively, “Services”). By purchasing, registering, or otherwise using our Services, you (“you,” “your,” “Client”) agree to comply with and be bound by these Terms. Please read this document carefully before using our Services. If you do not agree to these Terms, do not access or use our Services.

  1. Disclaimer and Medical Advice

1.1 Health and Medical Disclaimer: The content provided by MMD Fitness, including but not limited to workout programs, nutritional guidance, coaching sessions, meal plans, online content, videos, and written materials, is intended for general fitness and wellness purposes only. It is not intended to diagnose, treat, or cure any medical condition. Clients must consult with a qualified healthcare provider prior to beginning any exercise, diet, or supplementation program to ensure safety and suitability.

1.2 Assumption of Risk: By using our Services, you acknowledge that participation in physical exercise and nutritional programs carries inherent risks, including but  not limited to injury, illness, or other adverse health outcomes. You voluntarily assume all risks associated with using our Services and agree that MMD Fitness, its owners, staff, affiliates, and agents shall not be held liable for any harm, injury, or other negative consequences resulting from your participation.

  1. Coaching Services, Programs, and Subscriptions

2.1 Service Description: MMD Fitness offers digital coaching programs, personalized workout plans, nutrition guidance, meal planning, and one-on-one coaching sessions. All services are delivered digitally, via email, online platforms, apps (such as Trainerize), or live video sessions.

2.2 Personalization: While MMD Fitness designs personalized programs to meet your goals, results may vary due to factors such as genetics, adherence to the plan, lifestyle habits, and starting fitness level. No guarantees of specific results are made.

2.3 Subscription and Recurring Billing: If you subscribe to a recurring coaching plan, you authorize MMD Fitness to charge your chosen payment method automatically at the agreed intervals. Your access to coaching content and Services will continue as long as payments are successfully processed.

2.4 Cancellation of Services: Clients may cancel ongoing subscriptions with a minimum of fourteen (14) to twenty (20) days’ written notice submitted to info@mmdfitness.com. Prepaid packages are non-transferable and non-refundable once Service access or materials have been delivered. A reasonable administrative or cancellation fee may be applied to cover costs incurred prior to cancellation.

2.5 Refunds: Due to the digital and personalized nature of our Services, all sales are final once coaching materials or access are delivered. Refunds will only be considered for duplicate or accidental payments, which must be requested within seven (7) business days of the transaction. Any refunds will be processed in accordance with Paystack’s refund policies.

  1. Payment and International Transactions

3.1 Payment Methods: All payments are processed via Paystack, which handles secure online payment processing. Clients agree to adhere to Paystack’s terms and policies.

3.2 International Clients: Clients located outside South Africa acknowledge that all transactions are governed by South African law. Payments processed in currencies other than ZAR may incur additional fees from banks or payment providers, which are the responsibility of the client.

3.3 Chargebacks: Any disputes or chargebacks initiated through the client’s bank or payment provider will be handled per Paystack’s terms. MMD Fitness will provide evidence that Services were delivered as agreed. Clients agree to cooperate in resolving any disputes and acknowledge that frivolous or unjustified chargebacks may be contested.

  1. Client Responsibilities

4.1 Accurate Information: Clients must provide accurate, current, and complete information related to health, fitness, nutrition, and personal details. Failure to provide accurate information may affect program suitability and results.

4.2 Compliance: Clients must follow plans safely, exercise proper technique, and adhere to nutritional guidance. Any deviations are the sole responsibility of the client.

4.3 Account Security: Clients are responsible for maintaining the confidentiality of their login credentials and accounts. Unauthorized access due to negligence is the client’s responsibility.

  1. Intellectual Property

All content provided by MMD Fitness, including videos, written materials, images, graphics, logos, and programs, is protected by copyright and intellectual property laws. Clients are granted a personal, non-transferable, non-commercial license to use these materials. Distribution, resale, or public sharing of any content without written permission is strictly prohibited.

  1. Marketing Consent

By participating in MMD Fitness programs, clients grant full permission for MMD Fitness to use their progress photos, transformation stories, and testimonials for marketing purposes. This may include social media posts, website content, email campaigns, advertisements, and printed materials. Consent can be withdrawn at any time by sending written notice to info@mmdfitness.com. Upon receipt, MMD Fitness will cease future use and remove content where reasonably possible.

  1. Code of Conduct

Clients agree to:

  • Treat coaches, staff, and other clients with respect
  • Refrain from abusive, discriminatory, or threatening behavior
  • Adhere to all guidelines and instructions provided by MMD Fitness

Violation of the Code of Conduct may result in suspension or termination of Services without refund.

  1. Limitation of Liability

MMD Fitness, its staff, affiliates, and partners are not liable for indirect, consequential, or incidental damages resulting from the use of our Services. Maximum liability, if any, is limited to the amount the client paid for the Services.

  1. Termination

MMD Fitness reserves the right to terminate access to Services for any client who:

  • Violates these Terms
  • Fails to pay for Services
  • Engages in unlawful or fraudulent activity

Termination does not automatically entitle clients to a refund unless explicitly stated under Section 2.5.

  1. Governing Law and Dispute Resolution

These Terms are governed by the laws of South Africa. Any disputes arising from the use of our Services will be subject to South African courts. Both parties agree to attempt good-faith resolution before pursuing legal action.

  1. Changes to Terms

MMD Fitness reserves the right to update these Terms at any time. Updates will be posted on the website with a revised “Last Updated” date. Continued use of Services constitutes acceptance of the updated Terms.
